Terms of Service

These Terms of Service (“Terms”) govern use of eniwher3 at eni3.com, a browser spatial sticky-note board. eniwher3 at eni3.com is operated by @010gcc (“we”, “us”). By using the site you agree to these Terms and the EULA.

The service

Free use lets you run a local board in your browser (IndexedDB). You may optionally sign in with an email magic link. Premium unlocks cloud sync and multiple named boards, either as a monthly subscription or as Founder Lifetime (a one-time payment). Details: Product & services.

Accounts

  • You must provide a working email you control.
  • Magic links sign you in. Keep the link private; it is a one-time credential.
  • You are responsible for activity on your account and for the content of your boards.
  • We may suspend or close an account that violates these Terms or creates risk for the service or other people.

Subscription and billing

  • Premium is billed through Stripe Checkout as a recurring subscription (about US$5 per month; the Checkout page is authoritative).
  • Features unlock after successful payment is confirmed (return URL and/or Stripe webhook).
  • Subscriptions renew until you cancel. Cancel or update your payment method from Manage subscription. Refunds are described in Refunds & cancellation.
  • Prices may change; we will charge the then-current price on the next renewal after notice where required.
  • Failed payments may pause or end Premium until billing is fixed.

Founder Lifetime

Founder Lifetime is a one-time payment (US$39 once while the offer is open; the Checkout page is authoritative) that marks the purchasing account Premium for the life of the eni3.com service. It is non-transferable: it stays on the account that paid and cannot be moved to another person. Cloud sync under Lifetime has the same fair-use limits as monthly Premium — personal boards, not resale, scraping, or load that threatens the service. The offer is capped (100 sales unless we configure a different cap) and may close. If the eni3.com service ends, Lifetime access ends with it. A monthly subscriber who buys Lifetime is set to cancel at the end of the current paid period so the subscription does not renew; Premium remains because of Lifetime. If the cap is already filled when a payment completes, that payment is refunded and Lifetime is not granted.

Your content

You keep ownership of the notes and other material you put on boards. You grant us a limited license to host, back up, and display that content solely to provide the service (including Premium sync). You represent that you have the rights to store that content and that it does not violate law or these Terms.

Acceptable use

You may not:

  • Break the law or store illegal content.
  • Attack, scrape, or overload the service, or probe others’ data.
  • Impersonate others or abuse magic-link / email systems.
  • Use the service for malware, spam, or to process payments you are not authorized to make.
  • Resell the service as if you were the operator, or use it to run a competing hosted clone of our backend.

Availability

The service is provided as-is. Local boards can keep working when you are offline; cloud sync needs our servers and your account. We may change, pause, or discontinue features. We aim for reasonable uptime but do not promise uninterrupted access.

Disclaimer and limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, @010GCC AND ENIWHER3 ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST NOTES, LOST PROFITS, OR DATA LOSS. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US FOR PREMIUM IN THE THREE MONTHS BEFORE THE CLAIM, OR US$15 IF YOU PAID NOTHING.

Some places do not allow certain limits; in those places our liability is limited to the fullest extent allowed.

Indemnity

You will defend and indemnify us against claims arising from your content or your misuse of the service, to the extent allowed by law.

Governing law

These Terms are governed by the laws of the United States (without a more specific state named yet). Courts of competent jurisdiction in the United States (in the forum of the operator’s residence when a specific venue is required) will hear disputes, except where consumer law requires otherwise. This is a placeholder jurisdiction statement until a specific US state is named.

Changes

We may update these Terms. The “Last updated” date will change. Material changes to paid features will be announced by email or an in-app notice when practical. Continued use after an update means you accept the new Terms.
